This document outlines the Terms and Conditions for Heir Flow. Because Heir Flow provides self-service online tools for creating estate planning documents, these terms are legally necessary to protect both the platform and you, the user.
By using our website, you agree to be bound by the following provisions. If you do not agree, please do not use our services.

1. NO ATTORNEY-CLIENT RELATIONSHIP OR LEGAL ADVICE
Heir Flow is a technology platform, not a law firm. We provide automated software for self-guided estate planning.
Self-Service Nature: Heir Flow provides general information and automated software templates. We do not provide legal advice, opinions, or recommendations about your specific legal rights, remedies, or strategies.
No Attorney-Client Privilege: Your use of Heir Flow does NOT create an attorney-client relationship between you and Heir Flow. Communications with Heir Flow are protected by our Privacy Policy but are not protected by attorney-client privilege or as work product.
Representing Yourself: You are representing yourself in any legal matter you undertake through our services. If you require legal advice for a complex situation (such as estate taxes, special needs trusts, or contested inheritance), you should consult a licensed attorney in your jurisdiction.
2. ACCURACY OF USER-PROVIDED INFORMATION
The validity of the documents generated by Heir Flow depends entirely on the information you provide.
User Responsibility: You are solely responsible for the accuracy, completeness, and legality of the data you input. Heir Flow does not audit or review your answers for legal sufficiency or factual accuracy.
State-Specific Variations: Laws regarding wills, trusts, and powers of attorney vary significantly by state. While Heir Flow strives to keep its templates updated, we do not guarantee that every document is valid in every jurisdiction at all times as laws change frequently.
3. EXECUTION AND WITNESSING REQUIREMENTS
A document generated by Heir Flow is not a legally binding instrument until it is properly executed according to your state’s laws.
Formalities: Most states require specific signing ceremonies, including the presence of "disinterested" witnesses and/or a Notary Public.
Heir Flow’s Role: We may provide instructions on how to sign your documents, but it is your absolute responsibility to ensure that the physical execution (signing and witnessing) meets the statutory requirements of your state. Failure to follow these formalities may result in your documents being declared void by a probate court.
4. SCOPE OF SERVICE AND LIMITATIONS - Heir Flow provides self-service tools for general estate planning and personal documentation. While our platform is available for estates of any size for purposes such as medical authorizations and statutory filings, our document logic is not designed for:
Complex Tax Planning: Users whose estates require advanced strategies to navigate federal or state estate tax exemption limits.
Specialized Legal Structures: Estates involving international assets, complex business successions, or contested family dynamics.
Individuals wishing to disinherit a spouse or child (which may be restricted by state law).
Planning for business succession or complex intellectual property.
Establishing "Special Needs Trusts" for government benefit eligibility.
5. FEES, SUBSCRIPTIONS, AND REFUNDS
Payment: Access to certain document generation features requires payment of a one-time fee or a subscription.
Automatic Renewals: If you opt for a subscription (e.g., for document storage or updates), your account will be billed automatically at the end of each term unless canceled.
Refund Policy: We offer a [30-day] satisfaction guarantee. If you are unhappy with the documents provided, you may request a refund, provided you have not yet downloaded or printed the final, watermark-free versions of your documents.
6. INTELLECTUAL PROPERTY RIGHTS
Limited License: Heir Flow grants you a limited, personal, non-exclusive license to use our templates for your own personal use.
Prohibitions: You may not resell, redistribute, or use our documents for commercial legal services. The design, "look and feel," and proprietary logic of the Heir Flow questionnaire are the exclusive property of Heir Flow.
7. DIGITAL ASSETS AND STORAGE (THE "HEIR FLOW VAULT")
If you use our digital storage features:
Access: You are responsible for maintaining the confidentiality of your login credentials.
Fiduciary Access: You acknowledge that granting digital access to "Successors" within the platform does not automatically grant them legal authority under state law unless accompanied by a valid Power of Attorney or Trust provision.
Data Loss: While we employ industry-standard security, Heir Flow is not liable for data loss due to unauthorized access or technical failure. Always keep physical copies of your executed documents in a secure location.
8. DISCLAIMER OF WARRANTIES
HEIR FLOW SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, HEIR FLOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE DOCUMENTS PRODUCED WILL ACHIEVE ANY SPECIFIC LEGAL OR FINANCIAL RESULT.
9. LIMITATION OF LIABILITY
IN NO EVENT SHALL HEIR FLOW, ITS AFFILIATES, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THE USE OF OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO HEIR FLOW IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. DISPUTE RESOLUTION AND ARBITRATION
Mandatory Arbitration: You agree that any dispute arising from these terms or your use of Heir Flow will be resolved through binding individual arbitration, rather than in court.
Class Action Waiver: You waive the right to participate in any class action lawsuit or class-wide arbitration against Heir Flow.
Governing Law: These terms are governed by the laws of the State of Oregon, without regard to conflict of law principles.
11. MODIFICATIONS TO TERMS
Heir Flow reserves the right to update these Terms at any time. We will notify users of significant changes by posting a notice on our website or sending an email. Your continued use of the platform after such changes constitutes acceptance of the new Terms.
By clicking "I Agree" or by using the Heir Flow platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service.
